The short version

Keep in Memory is a one-time purchase app provided as-is by an independent developer. Use it responsibly for its intended purpose. The developer is not liable for any data loss or damages arising from use of the App.

1. Acceptance of Terms

By downloading or using Keep in Memory ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms are an agreement between you and Mustafa Kemal Demir ("Developer"), the individual developer of Keep in Memory.

2. Description of the App

Keep in Memory is a paid personal item tracking application for iOS that allows users to photograph items, save their GPS location, and retrieve that information later. The App is sold as a one-time purchase through Apple's App Store and is designed as a personal utility tool.

3. License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, solely for your personal, non-commercial purposes, subject to these Terms.

You may not:

  • Copy, modify, or create derivative works based on the App.
  • Reverse engineer, decompile, or disassemble the App.
  • Rent, lease, lend, sell, or sublicense the App to any third party.
  • Use the App for any unlawful purpose or in violation of any applicable laws.

4. Acceptable Use

You agree to use the App only for its intended purpose: tracking the location of your personal belongings. You agree not to use the App to:

  • Track individuals without their knowledge or consent.
  • Store sensitive personal information of third parties.
  • Violate any local, national, or international laws or regulations.

5. Your Data and Responsibility

All data you create within the App is stored locally on your device. You are solely responsible for the content you save, including photos and location data. The Developer has no access to your data and cannot recover it if lost.

It is your responsibility to back up your device if you wish to preserve your data. Deleting the App will permanently erase all associated data.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Developer does not warrant that:

  • The App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • The GPS location data recorded by the App will be accurate or complete.
  • The App will meet your specific requirements or expectations.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

The Developer's total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App at the time of purchase.

8. Purchases and Refunds

Keep in Memory is available as a one-time purchase through Apple's App Store. All purchases are processed by Apple and are subject to Apple's payment terms.

Refund requests must be submitted directly to Apple through the App Store. The Developer does not process refunds directly. You can request a refund via reportaproblem.apple.com.

The Developer does not offer additional refunds outside of Apple's standard refund policy.

9. App Store Terms

The App is distributed through Apple's App Store. Your use of the App is also subject to Apple's App Store Terms and Conditions. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to App Store-related matters.

10. Changes to the App or Terms

The Developer reserves the right to modify, suspend, or discontinue the App at any time without notice. These Terms may also be updated at any time. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the App after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
